I really do not see it as a hate crime per say
And I really doubt the prosecutor can make hate crime enhancement stick. Your arrangement is based on effect, not intent, the end result is the same, but intent is what triggers hate crime enhancement. I have been involved in the review and passage of two hate crime bills so the technicalities are familiar. All that said, I strongly agree with you, I hope they throw the book at them, and even then I do not see much justice being done because the crimes they are likely to get convicted of carry rather light sentences. I do hope the prosecutor at least asks for hate crime enhancement. And as BR says, this is why we need to be out and open about who we are
